1. Introduction & Acceptance
These Terms & Conditions of Use (“Terms”) govern your access to and use of:
www.thenaturalcook.com, www.naturalcookery.com, and any sub-domains (collectively, the “Site”);
the Natural Cook® learning portal, mobile apps, discussion forums, and any services, content, or functionality offered thereon (together with the Site, the “Platform”).
The Platform is owned and operated by White Dove Global Marketing, LTD and its affiliate The School of Natural Cookery (collectively, “White Dove Global,” “we,” “us,” or “our”).
By visiting, browsing, enrolling, purchasing, or otherwise using the Platform (collectively, “Use” or “Using”), you (“you” or “User”) agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not Use the Platform.
2. Eligibility
You must be at least 16 years old (or the age of majority where you live, if higher) and legally capable of forming a binding contract to Use the Platform. By Using the Platform, you represent and warrant that you meet these requirements.
3. Accounts & Credentials
Registration. To access certain features (e-g., purchase courses), you must create an account and provide accurate, current, and complete information.
Security. Keep your password confidential. You are responsible for all activity that occurs under your credentials. Notify us immediately of any unauthorized Use.
One User, One Seat. Accounts, course seats, and digital files are personal to the registered User and may not be shared, transferred, or resold.
4. Courses, Payments & Refunds
Course License. When you purchase or are granted access to a course, you receive a limited, non-exclusive, non-transferable, revocable license to view the course content for your personal, non-commercial learning. No intellectual-property ownership is transferred.
Prices & Taxes. All prices are listed in U.S. dollars unless noted otherwise and exclude applicable taxes, duties, or fees, which you are responsible for paying.
Payment Processing. We use third-party payment processors. By submitting payment information, you agree to the processors’ terms and authorize charges.
Refunds. Refund or cancellation requests are governed by the specific course or bundle policy displayed at checkout. Unless a written policy states otherwise, all sales are final.
Subscription Plans. If you enroll in a recurring plan, the subscription will renew automatically at the stated interval until you cancel through your account dashboard or by emailing [email protected] at least 3 business days before the next billing date.
5. Intellectual Property
Our Content. All videos, text, recipes, images, graphics, logos, trademarks, and other materials on or made available through the Platform (“Content”) are owned by or licensed to White Dove Global and are protected by U.S. and international copyright, trademark, and other laws.
Limited License. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and Use the Content solely through the Platform for your private educational purposes.
Prohibited Acts. You may not (a) download, record, copy, share, publish, or redistribute any Content except as expressly permitted; (b) remove or alter copyright or proprietary notices; (c) reverse-engineer, disassemble, or create derivative works; or (d) use our trademarks without prior written permission.
6. User-Generated Content
Your Content. You may submit comments, forum posts, assignments, photos, or other materials (“UGC”). You retain ownership of UGC, but by submitting it you grant White Dove Global a worldwide, royalty-free, perpetual, irrevocable, sublicenseable license to use, reproduce, adapt, publish, translate, and display such UGC in any medium for educational, promotional, or archival purposes.
Acceptable Use. UGC must not infringe any third-party rights, be unlawful, defamatory, obscene, harassing, or otherwise objectionable. We may, at our sole discretion, remove UGC and/or suspend accounts that violate these Terms.
DMCA. We honor Digital Millennium Copyright Act takedown notices. If you believe Content or UGC infringes your copyright, please email [email protected] with “DMCA Notice” in the subject line.
7. Acceptable Use Rules
You agree not to:
Violate any law, regulation, or court order;
Attempt to gain unauthorized access to the Platform or other Users’ data;
Interfere with or disrupt the Platform’s integrity or performance;
Use any robot, scraper, or other automated means to access the Platform without our express permission;
Frame, mirror, or otherwise republish the Platform without consent;
Upload viruses or malicious code;
Engage in any activity that competes with the Platform, including reselling course materials.
8. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR AVAILABILITY. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED.
9. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WHITE DOVE GLOBAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
Some jurisdictions do not allow certain exclusions or limitations; in such cases, our liability will be limited to the minimum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless White Dove Global and its affiliates from and against any third-party claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to (a) your Use of the Platform; (b) your UGC; or (c) your violation of these Terms or any rights of a third party.
11. Termination
We may suspend or terminate your access to the Platform (a) for any violation of these Terms, (b) if required by law or government request, or (c) for any reason upon reasonable notice. Upon termination, your right to Use the Platform and Content ceases immediately; Sections 5, 6, 8-12 survive termination.
12. Modifications to the Platform & Terms
We reserve the right to modify or discontinue the Platform (in whole or part) at any time. We may revise these Terms by posting an updated version and updating the “Last updated” date. Material changes will take effect 30 days after posting. Continued Use after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Oakland County, Michigan, in English, and the arbitrator’s decision may be entered in any court having jurisdiction. You and we waive any right to a jury trial or to participate in a class action. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction for intellectual-property or data-security breaches.
14. Miscellaneous
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Platform.
Severability. If any provision is unlawful or unenforceable, the remainder will remain in effect.
No Waiver. Our failure to enforce any right or provision is not a waiver of such right or provision.
Assignment. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, acquisition, or sale of assets.
